Rent dispute resolved in court
Hülya Avşar resolved a rent increase dispute with her tenant by taking the case to the Istanbul Civil Court of Peace. The property at issue is an apartment in the Büyükdere neighborhood of Sarıyer.
The case was a typical landlord tenant disagreement over the level of increase, ultimately settled by a court decision.
Background and failed mediation
The tenant, identified as B.Ş., had been paying 6,000 lira in 2019, and the rent had gradually risen to 25,000 lira. Last year, Avşar sought to roughly double the rent, which triggered the dispute.
Mediation efforts did not succeed, prompting Avşar to file suit at the Istanbul Civil Court of Peace to set the rent judicially.
The ruling and outcome
After review, the court found Avşar’s request justified and set the new monthly rent at 45,000 lira. With this decision, Avşar prevailed in a legal battle that had dragged on for some time.
The court ruled that the tenant must henceforth pay a monthly rent of 45,000 lira.
The ruling ends the long running debate over the rent increase in Sarıyer’s Büyükdere and clarifies the payment framework for both sides.
